THE 6-WEEK ANALYST REBOOT CHALLENGE
TERMS OF ENROLLMENT

The following Terms of Enrollment govern your participation in the Course presented by Ariel Analytics LLC (“Company”, “we”, “us”, “our”). Please read these Terms of Enrollment carefully.

By enrolling and participating in the Course being offered on Teachable, and using any corresponding content on our site (collectively, the “Site”) you agree that your use of our Site, participation in our Course, and use of Course Materials is governed by the following terms and conditions, together with our Terms of Service and Privacy Policy. You understand and agree that if you are accessing the Course on the Teachable platform, that Teachable has its own Privacy Policy and Terms of Use which apply to users on that platform.

1. The Course

The 6-Week Analyst Reboot Challenge: Make the Leap into Analytics (Data Engineering, Data Science, Business Intelligence) (“Course”) is an online course provided on the Teachable platform.

This Course is designed to help you:

• Identify what analytics role and setting is right for you
• Create a plan to bridge any gaps
• Take the next step with confidence

The Course consists of six (6) course modules:

• Your Unique Blend
• Your Best Fit
• Analytics Roles Deep Dive
• Take it to the Real World
• Minimize the Gap
• Move Forward

Each course module will provide information and resources through the following “Course Materials”:

• Videos
• Transcripts of videos
• Worksheets

2. Credentials

You understand and agree that this Course is not intended as a substitute for actual education, training, certification or experience in the field of data science, nor will it provide you with any credential upon completion. This Course is intended for individuals who are interested in making the leap into a more technical area of data analytics, such as: Data Engineering, Data Science, Business Intelligence AND one of the following applies. You are:

• An analyst, such as: data analyst, financial analyst, operations analyst, HR analyst, etc.

• In a technical role, such as: engineering, software engineering, science, etc.

• A manager or director with an analyst or technical background

• Recent or soon-to-be graduate from a science/technology/math undergraduate or graduate program or a data science bootcamp

If you have very little or no quantitative analyst experience and/or technical background or education, this Course is probably not right for you.

3. Your Participation

We are committed to providing all participants with a positive experience. Thus, Company may, at its sole discretion, limit, suspend, or terminate your participation in the Course or any of its courses, live, recorded, social media-based or digital without refund or forgiveness of remaining payments if you:

• become disruptive or difficult to work with;
• fail to follow the Course guidelines; or,
• impair the participation of our instructors or participants in our Course.



4. Course Content and Materials

You understand and agree that:

• Course education and information is intended for a general audience and does not purport to be, nor should it be construed as, specific advice, tailored to any individual.

• Course Materials are for personal use in or in conjunction with this Course only.

• Course Materials may not be sold, recorded, videotaped, copied or duplicated in any way, shared, taught, given away, or otherwise divulged without the express written consent of Company, or its designated agent.

• The information contained in Course Materials is strictly for informational purposes. Therefore, if you wish to apply ideas contained in this material, you are taking full responsibility for your actions.

• We assume no responsibility for errors or omissions that may appear in any Course Materials.

• Your access to the Course and Course Materials will require the creation of a username and password. Usernames and passwords may not be shared with any third-parties.

• Any violation of Company’s policies regarding content usage shall result in the immediate termination of your enrollment without refund.

5. Confidential and Proprietary Information

You understand that the Course, Course content, and Course Materials are confidential and proprietary to Company. You understand and agree that such content and Course Materials may only be used by you in a manner authorized by Company. Without limitation, you agree not to share, disclose, or otherwise disseminate any confidential or proprietary information of Company during or after your participation in the Course. Any information which is common knowledge or publicly available outside of this Course, absent any wrongful disclosure by a Course participant or any third party, is not deemed to be confidential. The reproduction, distribution and sale of Course Materials by anyone other than Company is strictly prohibited. If you violate, or display any likelihood of violating any of the agreements contained this paragraph, Company shall be entitled to injunctive relief to prohibit any such violations, and to protect against the harm of such violations.

6. Course Enrollment Fees and Refunds

The Course will be sold for a one-time fee of $399.99.

You may purchase a VIP upgrade, which includes access to virtual group live office hours with Stacey every other week for up to ninety (90) days after Course purchase. You can join as many of the sessions that you want during that time period, and Stacey will answer as many questions as she reasonably can during those sessions. The VIP upgrade may be purchased at the time of Course enrollment for an additional $99.00. If you do not purchase the VIP upgrade at the time of Course enrollment, but wish to add it later, the cost of the upgrade will be $149.99. This amount is subject to reasonable increase from time to time in the sole and absolute discretion of Company.

If you register for the Course during the pre-sale dates of February 1, 2023 through February 21, 2023, your one-time enrollment fee will be a discounted price of $249.99 and will include the VIP upgrade for free.

If you are not fully satisfied with the Course, you may request a refund within thirty (30) days of the date of purchase.

If you register for the Course during the pre-sale dates of February 1, 2023 through February 21, 2023 you may request a refund within (30) days of the course start date of February 22, 2023. You can request the refund through the Teachable platform within (30) days of the course purchase date. Beyond that date but within (30) days of the course start date you can request a manual refund by sending an email to contact@arielanalytics.com.



7. Limitation of Liability

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL WE, OUR SUBSIDIARY AND PARENT COMPANIES OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SITE, THE COURSE, COURSE MATERIALS, INCLUDING OUR MESSAGING, BLOGS, COMMENTS OF OTHERS, BOOKS, EMAILS, PRODUCTS, OR SERVICES, OR THIRD-PARTY MATERIALS, PRODUCTS, OR SERVICES MADE AVAILABLE THROUGH THE SITE OR BY US IN ANY WAY, EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CATEGORIES OF DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, OUR LIABILITY AND THE LIABILITY OF OUR SUBSIDIARY AND PARENT COMPANIES OR AFFILIATES IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.) YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT WE ARE NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER. IF YOU ARE DISSATISFIED WITH THE SITE, COURSE, COURSE MATERIALS, ANY MATERIALS, PRODUCTS, OR SERVICES ON THE SITE, OR WITH ANY OF THE SITE'S OR COURSE’S TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE AND/OR COURSE AND THE PRODUCTS, SERVICES AND/OR MATERIALS.

The Course, Course Materials and Site are continually under development and Company makes no warranty of any kind, implied or express, as to its accuracy, completeness or appropriateness for any purpose. The information provided in this Course is sold and provided on an “as is” basis. Company does not promise or guarantee any income or particular result from your use of the information contained herein. Those results are your responsibility as the end user of the Course. In particular, Company shall not be liable to you or any other party for any damages, or costs, of any character including but not limited to direct or indirect, consequential, special, incidental, or other costs or damages, in excess of the purchase price of the Course. These limitations may be affected by the laws of particular states.

9. License

Your use of, and access to the Course Materials is on a licensed basis. In that regard, Company hereby grants to you, and you hereby accept, the non-exclusive right, license and privilege to use (but not sublicense) the Course Materials. You will be provided with Lifetime Access to this Course and the Course Materials. For purposes of this Agreement, "Lifetime Access" shall mean, for so long Ariel Analytics LLC maintains this Course on the Teachable platform. Notwithstanding the foregoing, your access may be terminated at any time in accordance with the terms of this Agreement, and your license to the Course Materials shall immediately terminate.

You agree to:

(a) constantly use your best efforts in the use of the Course Materials in a way to protect the good name and goodwill associated with the Course Materials and Company;

(c) not to attack the title of Company in and to the Course Materials nor attack the validity of the license granted hereunder;

(d) not harm, misuse or bring into disrepute the Course Materials and Company, but to the contrary, to maintain the value and reputation thereof to the best of your ability; and

(f) at all times comply with all applicable government laws, rules and regulations, and all voluntary industry standards relating or pertaining to the use of the Course and Course Materials.

The license granted herein does not grant you any right, title or interest, at law or in equity, in or to any of Company’s trademarks, service marks, copyrights, copyrighted material, or any derivative uses thereof, or the name, likeness or image of Stacey Schwarcz, or trade secrets or other rights or intellectual property of any kind, except as provided by said license. Further, such license applies only to those Course Materials designated herein. You shall not represent to others, or conduct yourself in any manner that might indicate to others, that you possess any other legal or equitable rights in our Course Materials, trademarks, copyrighted materials, trade secrets or other rights or intellectual property of any kind other than by virtue of the license granted hereunder.

Company shall have the right to approve all uses of the Course Materials or derivative uses thereof.

Company shall have and hereby reserves all rights and remedies which it has, or which are granted to it by operation of law, to enjoin the unlawful or unauthorized use of the Course Materials (any of which injunctive relief may be sought in the courts, and also may be sought prior to or in lieu of termination), and to be compensated for damages for breach of this Agreement.



10. Dispute Resolution

All disputes arising under or concerning this Agreement are to be submitted to binding arbitration, in New York, New York, to be resolved in accordance with the laws of the state of New York.

You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren't allowed.

The arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action or private attorney general action) unless all relevant parties specifically agree to do so following initiation of the arbitration.
